FlowBJJ, Inc. Training Waiver and Automated Billing Agreement

Participation is possible only if the participant accepts the following waiver of liability and membership billing agreement, which releases FlowBJJ, Inc., its owner, instructor(s), and agents from all liability both criminal and civil.

I, {name}, affirm that I am in good physical condition and mental health and is aware that all activities, especially those with regard to actual physical training in mixed martial arts, are entirely voluntary, and any member can at any time elect not to partake in any activity which he/she feels may involve some element of risk or discomfort to his/her person. 

Accordingly, the applicant accepts all conditions of membership and agrees to hold FlowBJJ, Inc., the school's affiliated venue, and all other instructors and members harmless from liability for damages for any injuries, including but not limited to death and disability arising from any of the activities of the school. 

I, {name}, also understand that any treatment for injuries sustained will be of a first-aid type only, given with my permission. I know there are risks involved in such activities and that unanticipated risks may arise during such activities. The use of the equipment, facilities and premises shall constitute acceptance of that risk regardless of the nature of the injury or medical condition. I recognize that donation dues are nonrefundable, even upon injury or illness.

To maintain a safe environment and health-conscientious training, I will observe all school rules and safety guidelines and endeavor to use common sense at all times during my participation.

The terms of this agreement will serve as a release and indemnity agreement for my heirs, personal representative, and for all members of my family, including any minors.

I, {name}, further state that I am eighteen (18) years of age or older and legally competent to sign this release, that I understand these terms are contractual and not mere recital, and that I have signed this document as my own free act. (A parent or legal guardian must sign for all persons under eighteen (18) years of age.)

Photo/Video Release

On occasion FlowBJJ, Inc. may use literature, photos, and video to promote FlowBrazilian Jiu JItsu to the general public. I understand that I will not receive compensation in any form from the use of their photograph or their photographic likeness and recorded voice. I hereby consent to the use of my name, photograph, photographic likeness, recorded voice, and/or image in the video that may appear in any publications, promotional posters, flyers, brochures, printed and electronic ads or electronic media, in addition to the FlowBJJ, Inc. website.

Text Alerts, and Communication

FlowBJJ, Inc. will be sending you text alerts regarding your account, special offers, club changes & more. Standard data or text rates may apply. 

FlowBJJ, Inc. will also email you on occasion concerning your membership account, coach updates, and news relevant to the gym. You can opt-out of our messages at any time.

Membership Billing

In consideration of the opportunity to participate in activities sponsored at FlowBJJ, Inc. I have read and agree to the following terms and conditions with my membership.

Members are billed on the same day each and every month for the duration of their chosen membership at FlowBJJ, Inc.. Billing for Membership is automatic and will occur independently of attendance or participation in classes. Annual Memberships are set up as a fixed 12-month membership at FlowBJJ, Inc.. Memberships are set to renew automatically and will be renewed on the anniversary date of the member unless canceled in writing ahead of time.

Memberships can not be paused or suspended during an Annual Membership.

Membership changes or cancellations must be filed by submitting the necessary document(s) at the academy. All changes or cancellations must be submitted at least thirty (30) days in advance. Phone calls, emails, facebook messages are not accepted.

Failure to meet the cancellation deadlines stated above will result in the member being responsible for any remaining obligations for the duration of their membership or until such time as the cancellation is properly entered. Members may prematurely cancel their membership by paying an early termination fee of fifty percent (50%) of the total remaining annual amount owed. FlowBJJ, Inc. does not grant credit or issue refunds for missed classes or dues that occur from member’s failure to file changes before applicable deadlines. FlowBJJ, Inc. is not responsible for any bank fees incurred by the member. FlowBJJ, Inc. has the sole right to modify any payment due date and to resubmit returned or declined items (plus applicable fees) without prior notice. Refunds or credits will only be considered in the case of a billing mistake on the part of FlowBJJ, Inc.. Refunds issued by FlowBJJ, Inc. will be processed within 30 days of the request of the member.

Members are in full control of their billing. If at any time after the initial membership a member decides to discontinue, the guidelines stated herein must be abided by.

Arbitration. If a dispute arises from or relates to this contract or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. The parties further agree that any unresolved controversy or claim arising out of or relating to this contract, or breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Severability. The parties stipulate and agree that all clauses and provisions of this Agreement are distinct and severable, and it is their intent that in the event this Agreement is ever held to be invalid or unenforceable (in whole or in part) as to any particular type of claim or charge or as to any particular circumstances, it shall remain fully valid and enforceable as to all other claims, charges, and circumstances.

Successors in Interest Bound. This Agreement shall inure to the benefit of, may be enforced by, and shall be binding on, the parties and their heirs, executors, administrators, personal representatives, trustees, receivers, corporate affiliates, partnership affiliates, assigns and successors in interest.
